Terms and Conditions
The general terms and conditions of sale detailed below only govern the contractual relationship between the User (hereafter referred to as You) and Coditek (hereafter referred to as We) belonging to the company TechPlaza EU VAT Number PT507924320 :


General

The prices indicated on the Site are in Euros and include all taxes but do not include delivery. The chosen possible delivery costs are indicated for the User during the product selection and are invoiced at the end of the order in addition to the price of the products.

We reserve the right to modify our prices at any moment.

We would like to inform you that if an obviously incorrect price appears on our website (a price that is clearly too low, for example), and for whatever reason (IT bug, human error, technical error etc.), your order will be cancelled, even if it has been initially validated. We update the information daily in order to ensure that all our products have the correct and up-to-date information, thus minimizing any possible error situations that may occur. The customer should always check the manufacturer's website to confirm all the details of the item. For technical reasons, the colors shown may differ slightly from the actual colors of the articles.

The availability and delivery period indicated in the articles may change due to any problems that occur during the transport and delivery of an order or due to a momentary stockout, and the customer will be informed of these changes whenever possible.

Since the details you give us are essential for the processing and delivery of orders, for billing and for the establishment of warranty contracts, you authorize Coditek to save, handle and use your personal informations.

The customer has the permanent right to access and rectify all the information that concerns him/her. The customer can consult and modify all personal data through its client area. If you want the complete elimination of your registration data, you may request it by sending an email to our customer service.

Only Coditek has access to the customer's personal information.

Coditek is not responsible for damages resulting from any computer viruses or any other situations to which it is unrelated and that prevent access and correct functioning of the domain www.codi-tek.com as well as the services made available therein.


Payment

Coditek offers 5 methods of payment depending on the product purchased:

  • Bank Transfer

  • PayPal

  • MB Way

  • Referência MB

  • Credit Card

    For payments made on-line by credit card the "Secure Socket Layer"(SSL) is used, which allows your banking information to be encrypted when on the network.
    Coditek don't have access to your credit card number.


Ordering

Coditek reserves the right to unilaterally cancel any orders whose final price is wrong or out of date or whenever there is a programming error, malfunction of Coditek's computers as well as the wrong contractual proposal arriving at its destination and the error concerns an essential element of the contract. The customer will be notified of this fact before the payment has been made, however if the payment has already been made the customer will be full refunded.

Coditek reserves the right to cancel any orders for which payment has not been made within 3 working days after the order was submitted.

Orders will only be processed after confirmation of payment has been made and will be sent to the address requested at the time of ordering, so it is not possible to guarantee the availability of the items until the start of the order processing.

If the items are not in stock in our warehouse as they are items ordered upon request, a partial payment may be required to proceed with the order for the item. The partial payment will be 30% or higher (if agreed between both parties) and only after confirmation of payment will the agreed delivery time begin to count in working days. In case of order cancellation by the customer or return of the item (if applicable), the partial payment will not be refunded. If there is a delivery time much longer than agreed, Coditek will refund the customer and allow to cancel the order.

After the notification that the item is available for collection/pick up and the payment has already been made, the customer has 30 consecutive days to proceed with the collection. After this period, the order is canceled without any right to compensation or refund.

All orders are delivered only on working days.

If the User is absent at the time of delivery, the carrier will leave a note giving them details of how to collect the parcel themselves, or informing them of when another delivery will be attempted.

If the carrier is unable to deliver the merchandise for reasons related to the buyer (absence, incorrect address, etc.) Coditek shall not be held responsible for the delay in delivery.

Items are transported at the buyer's expense and risk, and charges are applied if the User does not claim the parcel and it is returned to Coditek.

Items are subject to availability. In case of unavailability the buyer will be notified by email as soon as possible and the order is immediately cancelled, unless the buyer agrees with the new delivery date or accepts the nearest match in colour, price or specs to the ordered product.

Upon reception of your order, we recommend that you verify your products with the order that you placed with us and if necessary, write any anomalies that may have occurred on the delivery voucher, not forgetting to sign it. Please note that we cannot accept any claims regarding incomplete orders or damaged items if not claimed within 24h after delivery date.

Please note that all countries outside the European Union Community may have customs fees and taxes applicable for clearance, which differ from country to country and which we are not aware of.

All these fees are at the customer's expenses. If the customer declines the merchandise reimbursement will not take place. Instead for retrieving the goods the customer shall pay another dispatch.

Any order shipment delay that may occur in regard to the Shipping date displayed, does not entitle the customer to any compensation.

Any change to the order information, after it has been submitted, must be communicated by email and before the order shipment. If the shipment has already taken place, additional costs may be incurred to the customer.

Any offers or gifts associated with a product ordered will always be subject to stock confirmation and may be canceled without previous notice.

Orders placed by business or professional customers cannot be canceled after payment has been made, unless stock is permanently out of stock.

In orders to the Azores and Madeira, Coditek is not responsible for any delays in delivery or irregularities that occur in the connections (air or sea) of CTT, which could compromise the delivery times indicated on our website. We do guarantee that the shipment takes place within the time indicated on the website.

Free Shipping campaigns are not applicable to the Azores and Madeira, except for cases, covers, small bags and other telecommunications accessories, which will be sent by CTT.

Same-day delivery costs €13.9 and is available as an option only for orders for items in stock and whose delivery address is within a 25km radius of our Lisbon facilities. This service only allows you to select deliveries in the time windows 12:00-14:00, 14:00-16:00, 16:00-18:00 and 18:00-20:00 on weekdays.


Returns

For any returned package, please contact us by e-mail (info@coditek.pt) or phone + 351 21 0101 013 and wait for the instructions for returning your products.
Coditek allows you 14 days to return a product that you are not satisfied with. Your right of retraction starts from the moment your order is delivered. You can return the product within this time frame, at your own expense, with your invoice. Otherwise Coditek reserves the right not to accept the return.

The period for exercising the right of returning the order expires 14 days from the day following the day on which the consumer or a third party appointed by him, other than the carrier, acquires physical possession of the goods.

The consumer must return the goods, without undue delay and no later than fourteen (14) days from the day he informed Coditek of the return, considering that the same is respected if the consumer returns the goods before the expiry of this period of 14 (fourteen) days. You must return the goods properly packaged, with original packaging, to the following address (IMPORTANT: If returning by CTT, make sure that the delivery is made directly to our facilities and not to CTT stations):

The costs of returning the order will always be fully borne by the consumer, regardless of its nature or size. If the product to be returned cannot be returned by regular mail, its cost may reach a maximum of €250, depending on the volume and weight of the product to be returned.

We request that you send us the merchandise by registered post and that you purchase insurance with the carrier for the value of the merchandise. This is necessary should they lose or damage the goods. Shipping fees remain the customer’s responsibility. The present right of return only applies to products that are returned in their original, complete working condition (packaging, accessories, user guide etc.). Any product that has been damaged, is not in its original packaging, has packaging that has been worn beyond simply opening the product, will not be refunded. Please note that the right of retraction does not apply to unsealed CDs, DVDs, and computer software also sealed products that may not be returned for health or hygiene reasons, which were unsealed by the customer after delivery.

Coditek will not accept returns of any custom-ordered or customized products.

Important: For health and hygiene reasons, returns of toiletries or personal care items will not be accepted (eg epilators, hair cutters/dryers, razors, hair straighteners/straighteners, dental hygiene products, massagers and their accessories) , as well as earphones, headphones, microphones and any other equipment that is in direct contact with the body (eg fitness bracelets, watches, smartwatch and similar), when opened after delivery.

Hard disk or memories (USB or PC) returns will not be accepted if the original packaging has been opened.

Coditek will not accept the return or exchange of items with evident signs / wear and tear. The consumer will be held responsible for the depreciation of the item, if the manipulation carried out to inspect the nature, characteristics and functioning of the item exceeds the manipulation that is usually allowed in commercial store, in which case it is considered that the item does not meet the conditions for the return process can be completed and therefore the return or exchange is not accepted by Coditek.

The client will be reimbursed via the same payment method as was used initially. Coditek will do its best to reimburse the client as quickly as possible for a maximum period of 14 days.

In case of return of items picked up or purchased directly at our facilities, the refund will always be made by bank transfer.

No returns will be accepted for items purchased by professional or business customers.

Please note that shipping fees are the client’s responsibility.


Litigation and responsibility

In case of litigation with business clients, the courts of the district of Lisbon will be competent, expressly waiving any other legal jurisdiction.

Coditek will not be held liable for poor use and its consequences on the products purchased from our site.

In case of legal dispute, in the interpretation or application of these conditions, the court of the district of Lisbon, Portugal has jurisdiction, with express waiver of any other.

Warranties

In case of use by non-professional consumers, the normal warranty will be 3 years. The Warranty period may change without previous notice by the manufacturer unilaterally and according to the kind of article and its purpose (i.e Professional use may grant a one-year warranty period whenever is determined by the manufacturer).

The legal guarantee concerning product conformity does not apply in some cases:

  • when damage is caused by external factors such as shocks, lightning, power surges, rust and sand.

  • when damage is caused by the customer’s non-respect of the manufacturer’s instructions regarding the use and installation of the product.

  • when damage is caused by the customer’s misuse of the product.

All consumables and batteries have a 12-month warranty, unless otherwise stated by the manufacturer.

Broken or damaged equipment that is sent to Coditek without prior notice will not be accepted. All requests for technical assistance must be requested by the Customer Area of the site, using the options available for this purpose.

The repair period depends exclusively on the manufacturer or the entity designated by it to carry out the repair. Coditek will not be responsible for any repair deadlines and the customer should contact the official manufacturer/repairer.

The cost of shipping the broken/damaged product is the customer's responsibility and only products whose shipment has been previously communicated to Coditek will be accepted.

In case of confirmation of the damage, the product will be replaced (or repaired), if the damage is not confirmed, the shipping costs will be fully borne by the customer.
